Whether a fence needs a permit depends on the city or county your property is in, not on the address on your mailbox. Katy and its neighbors sit across several counties and dozens of municipal utility districts, so the answer changes within a few miles. This page shows where to check for each area we serve and what usually triggers a permit. We do not list permit fees or rules that we have not verified.
Who to ask, by area
The table shows what each official source says as of September 2026. Several sources are silent on residential fences, so a blank does not mean no permit is needed. Some entries come from the city's own code or pages; where an official source was unavailable we say so.
| Area | What we found | What to do |
|---|---|---|
| City of Katy | Permits and Building, 281-391-4830. The city's permit list does not mention fences. A third-party site says none is needed, which we could not confirm. | Call the city, and first confirm the address is inside city limits. |
| Unincorporated Fort Bend County (Cinco Ranch, Seven Meadows, Aliana and others) | County Engineering, 281-342-3411. Its permit list covers floodplain work, larger structures, fill and driveways, and does not mention fences. | Ask County Engineering, and check floodplain status. |
| Unincorporated Harris County (Cypress, Bridgeland, parts of Katy) | Harris County Engineer. Permit page does not mention fences; floodplain rules apply. | Ask the county, especially in a floodplain. |
| Fulshear | Development Services. We could not find a stated fence rule. | Call the city. |
| Richmond | Building Department, 281-232-6871. City code has a Fence Permit section. | Ask for current requirements. |
| Rosenberg | Building department, 832-595-3500. Residential packet lists fences over 7 ft as a permit item; contractors must register. | Confirm the rule for your height. |
| Brookshire (Waller County) | Full ordinance: permit required to build or rebuild; 8 ft side and rear, 6 ft front; front fences over 4 ft 75 percent open. | See the Brookshire page. |
| Sealy (Austin County) | Planning and Community Development, 979-885-1669. Fences over 7 ft need a permit; contractors register first. | Confirm the rule for your height. |
| Wharton | Code Enforcement, 979-532-2491. Code exempts fences up to 7 ft, but a 2025 fencing ordinance exists that we could not read. | Ask about the 2025 ordinance. |
| Brenham | Development Services, 979-337-7220. Fencing needs a permit; 8 ft residential maximum; historic district rules. | See the Brenham page. |
| Bellville | Building permits, 979-865-3136. Fences not explicitly listed. | Call to confirm. |
| Columbus | Building Official, 979-732-2366. Fence permits fall under building codes. | Call to confirm. |
What usually triggers extra rules
- Height: many places allow a taller fence in the back than in the front.
- Pool barriers: commonly governed by local building codes and often need a self-closing, self-latching gate.
- Corner lots: visibility triangles near intersections can limit fence height.
- Gates with operators: electrical and safety requirements may apply to automatic gates.
- Retaining walls and columns: structural rules apply above certain heights.
- Flood plains and drainage: fences that cross a drainage easement or floodway may be regulated.
